COVENANT
NOT TO SUE

RECITALS:

WHEREAS, the undersigned is the legal parent or guardian of a child participating in activities conducted by ST. PIUS X MONTESSORI HOMESCHOOL HYBRID (hereinafter referred to as the "Program");

WHEREAS, the undersigned fully understands and acknowledges the inherent risks involved in such participation;

NOW, THEREFORE, in consideration of the premises and the covenants contained herein, it is hereby agreed as follows:

SECTION 1: ACKNOWLEDGMENT OF RISKS

I, the undersigned, hereby acknowledge and understand the nature and extent of the inherent risks involved in my child's participation in the Program's activities, including but not limited to risks of property loss, bodily or personal injury, sickness, and other unforeseeable risks.

SECTION 2: ASSUMPTION OF RISKS

I knowingly, willingly, and voluntarily assume all such risks and responsibilities for any damages, liabilities, losses, or expenses that I or my child may incur as a result of participation in the Program's activities.

SECTION 3: RELEASE AND COVENANT NOT TO SUE

I hereby release, waive, discharge, and covenant not to sue the Program, its staff, volunteers, and related entities from any and all claims, demands, rights, expenses, actions, and causes of action, present or future, arising out of or connected with my child's participation in the Program's activities. This release extends to all claims of every nature and kind whatsoever, foreseen or unforeseen, known or unknown.

SECTION 4: INDEMNIFICATION

I agree to indemnify and hold harmless the Program, its staff, volunteers, and related entities from any loss, liability, damage, or cost they may incur due to my child's participation in the Program's activities.

SECTION 5: EMERGENCY AUTHORIZATION

In the event of an emergency, I authorize the Program's staff to take whatever actions they deem warranted and appropriate regarding my child's health and safety, including seeking medical treatment at my expense.

SECTION 6: VOLUNTARY CONSENT

This consent is given freely and voluntarily by me without coercion, duress, threat, or promise of any kind. I certify that I am the legal guardian or parent of the child, have full legal capacity to consent, and have read and understood this document in its entirety.

SECTION 7: SEVERABILITY

If any provision of this agreement is found to be unenforceable or invalid, that provision shall be severed, and the remainder of the agreement shall continue in full force and effect.

SECTION 8: GOVERNING LAW

This agreement shall be governed by and construed in accordance with the laws of the state in which the Program is located.

IN WITNESS WHEREOF, the undersigned has executed this Covenant Not to Sue and Release of Liability as of the date first below written.
